Stephen O’Donohue is an associate in the New York office of Latham & Watkins and a member of the Intellectual Property Litigation Practice.

Mr. O’Donohue focuses his practice primarily on patent litigation. He represents clients in federal district court, the International Trade Commission (ITC), and before the Patent Trial and Appeal Board in cases involving various technologies, including semiconductors, consumer electronics, and medical devices.

Mr. O’Donohue’s litigation experience includes fact discovery, motions practice, and claim construction. He also has experience preparing and filing inter partes review petitions.

Prior to joining Latham, Mr. O’Donohue served as a law clerk to Judge Claire C. Cecchi of the US District Court for the District of New Jersey. Before law school, Mr. O’Donohue was an engineer in the aerospace and optics manufacturing industries for ITT Space Systems and QED Technologies, where he published several papers on interferometric testing of aspheric surfaces and is a named inventor on a US Patent.

Mr. O’Donohue is admitted to the Southern District of New York and Eastern District of New York.

Mr. O’Donohue’s representative matters, include advising:

  • In the Matter of Certain Computing or Graphics Systems, Components Thereof, and Vehicles Containing Same (USITC): Respondent NVIDIA in multi-patent case relating to graphics processing technology; obtained favorable settlement prior to claim construction
  • Major producer of electronic and fiber optic cables in multi-patent matter relating to high speed data transfer cables and signal integrity; obtained walk away by petitioner before trial
  • A global medical supply company in a patent litigation involving ultrafast laser technology and LASIK vision correction
  • Major outdoor advertising company in a multi-patent and trade secret matter involving light emitting diode technology and non-imaging lens design
  • Leading auto insurance company in a patent litigation involving two dimensional bar codes and bar code scanners; the case resulted in a walk away by the plaintiff months away from trial
